The Bar Association interview Chinese Human Rights Lawyer Guoting Guo
The Bar Question 1. Why You had to leave China for Canada.
Guo Answer: I have been practicing as a maritime lawyer for 21 year and turn to be a Human Rights lawyer since January 2003. Because I learn that so many young talents were arrested and sentence into prison only for their speech and writing. Thus I published articles to express my opinion on Chinese Communist Party’s policies, judicial system, political system, and rule of law. Starting defence political dissidents and cyber writers and journalist since January 2003, as the defense lawyer of Mr.Zheng Enchong, Mr.Huang Junqiu, Mr.Yang Tianshui, Mr.Shi Tao, and Mr.Zhang Lin; Ms.Ma Yalian and Ms. Wang Shuizheng; Falun Gong practitioners, Mr.Qi Yanlai, Mr.Chen Guanghui, and Mr.Lei Jiangtao. I was thereafter harassed and revenged by the Chinese government. On February 23rd,2005, Shanghai Judicial Bureau suspended my lawyer license and seize my computer, policemen searched my home and my law office again on March 6th,2005, detained and released me on bail, then put me under house arrest and under strict surveillance till I left China on May 20th,2005. My family members were harassed by telephone tapping and following by policemen whenever they went. The CCP forbidden me to practice in China or to be a teacher in any university, which deprive the any possibility to make a living, and threat me to persecute me as overthrow State Power (government),This is why I have to left my beloved motherland.
The Bar Question 2．Can you exercise your profession in Canada?
Guo Answer: I don’t have the law license of Canada and it is impossible for me to practice in Canada at the moment, Because My English is not good enough, also make me very hard to find a suitable job in Canada, therefore, I have to go to university again to improve my English then try to study law again. Now I am study my LLM program in the University of Victoria , however, it is not easier for me since my English is poor, I have no choose but have to try my best to improve it as soon as possible.
The Bar Question 3．Do you still fight for human rights in China from overseas?
Guo Answer Yes. I never stop fighting with the Communist regime and have done great deal to fight for Democracy and Human Rights in China, Since I come to Canada I have been published more than 350 essays and articles criticize the CCP’s political and legal system and defense for human rights activists. please see the attached list essays which I published against the CCP on political and legal system and democracy and Human Rights in China[foot note]
The Bar Question 4. What daily main difficulties do human rights lawyers face in China?
Guo answer. Chinese Human Rights lawyers meet very heavy pressure which come from the CCP, usually they will under surveillance and their cell phone home and officer telephone will be tapping by the police. Such pressure come from three way, Economic political and spirit. The top one is the economic pressure. Because the CCP will revenge any human rights lawyer who dare openly defense for political dissidents and Falun Gong practitioners and any sensitive cases, by take away their law license or suspend their law license even put them into labour camp or into jail, which means the lawyers who will lost their job and will have no income at all. And this is the most difficulties human rights lawyers face in China. I have been tried to set up the Foundation of Chinese Human Rights lawyers, and this is also my purpose to attend the competition for the 2008 Asia Democracy and Human Rights Awards, and I will use the Award to set up the Foundation to help Chinese human Rights lawyers if I win the Award.
The Bar Question 5. How is the legal profession organised?
Guo Answer . In China all profession organisation are totally controlled by the CCP, and all legal profession organisation cannot escape at all. The CCP simply forbidden any private organisation for they afraid they will development and strong enough to change the power of the CCP, all people who try to organisation political organisation will be arrested and charged as overthrow State Power( government).Thus, any organisation must be have the spy or the CCP in charge of them.
The Bar Question 6．Are the legal associations independent from the Chinese authorities?
Guo Answer. No. the legal associations all totally controlled by the CCP, they are sub-official organisation and has no free will at all.
The Bar Question 7. What kind of support could be giving to Chinese human rights lawyers?
Guo Answer. First, Stop immediately the official way to cooperate with Chinese government, which is totally controlled by the CCP, to cooperate with private organisation such as the Foundation of the Chinese Human Rights Lawyers. Second , Invited Chinese Human rights lawyers to attend international conference and sponsor them to study and train in Free democracy country. Third , Reward those genie Human rights lawyers who are persecute by the CCP and lost their law license and appeal for them when such persecute happened. Fourth , sent the top officer of China blame their illegal action and appeal for any one who suffer from the persecute. Fifth, help to train Chinese Human rights lawyers. Sixth, sent France Human Rights lawyers to China university to teach there to influence the law student in China directly. [footnote]
