Cong. Tom Lantos本月16日宣布议会的外交事务委员会将在11月6 日针对Yahoo! 于2006年二月提供给国会的“不诚实”证词举行听证会。在该次听证会中Yahoo!曾称“它不知道该调查的任何事情” 。而它提供用户的资料给中国政府曾导致许多人例如师涛和其他人权民主人士被捕,且遭受长时间的监禁和酷刑。
另据报道,美国通讯公司如Verizon等也在美国国内监听项目中不适当的将用户的个人资料泄漏给了美国执法部门。
这两个案件都将在11月1日于加州Oakland举行听证会。Yahoo!试图豁免责任,它认为自己是被迫提供网络用户的资料给中国的执法部门。而它的行为与美国通讯公司泄漏用户个人信息给美国国家安全部门是同样的性质。因此,起诉Yahoo!案中师涛和其他原告将要引用国会本次听证会其中包括Verizon泄漏信息一案的内容来支持他们诉讼Yahoo!泄漏有关信息与资料,以及与中国当权者配合的行为。

On November 1 the first court hearing in the Yahoo! case will be taking place before Federal Judge Claudia Wilkin in Oakland, and is likely to consider recent developments regarding the allegation that Yahoo! lied to Congress to cover up its role in providing Internet user identifying information to Chinese officials, and related unlawful disclosures by Verizon and other U.S. telecommunications companies in connection with the domestic surveillance program.
Cong. Tom Lantos announced on October 16, 2007 that his House Foreign Affairs Committee would hold hearings on November 6 on allegedly “untruthful testimony” that Yahoo! provided to Congress in February, 2006, that it “knew nothing about the nature of the investigation” by Chinese authorities that resulted in their providing user contact information that resulted in a number of arbitrary arrests, long-term imprisonments and torture of journalists like Shi Tao and human rights and democracy advocates in China.
It also was reported on Oct 16 that U.S. telecommunications companies unlawfully and inappropriately revealed user information to U.S. law enforcement authorities in “hundreds of cases” under the domestic surveillance program.
Both these developments are likely to be considered at the first court hearing in the Yahoo! case taking place on Nov. 1 in California. Yahoo! is seeking dismissal of the case based on the theory that it was compelled to provide the internet user information to Chinese law enforcement officials, the same type of justification used by U.S. companies for explaining why they illegally gave the National Security Agency U.S. user information without the required court documents. Shi Tao and the other Plaintiffs in the Yahoo! case will be citing the Congressional hearings and the Verizon revelations in support of their request that the court authorize discovery that would reveal more about the actual nature and extent of Yahoo!’s cooperation with Chinese authorities.
